I am planning to renew my passport. Current passport is going to expire in October 2008.
Currently my I-485 is pending. If I renew my passport, do I need to update my renewed passport number to USCIS?
I never updated USCIS about the new passport.Recently I re-entered US and used a new passport with AP. I had no issues at all. So, I think it shoud be ok. They may just update your new passport number in the system when you re-enter the country the next time.

Will there be any chance to revoke or cancel approved i140 if we file 2nd i140 with same employer . My employer is willing to give approved labor which is better (EB2 ,PD-2003) than my labor (EB3, PD-2003) . But right now i am on 6th year . I got a 3 years H1B extension recently. If my first i140 canceled (??) how about my H1B . is it still valid?

I held an H1 B Visa from 2005 to 2008. I worked in the US from for 1 year from 2006 to 2007. I had to return to my home country and my visa expired in 2008. I have been out of US for more than a year and now I am on H4 status (not employed currently) and I would like to know the below:
1. Am I eligible to renew my previous H1 visa. Will my visa petition be considered as an extension of my previous H1 B?
2. Will my application fall under the cap exempt or will I be subject to cap limit
3. If the above fail, what other options do I have?
Pls guide.

Long ignored when their party was in control, moderate Republicans are the new power brokers in an increasingly bitter series of veto confrontations between President Bush and the Democratic Congress.
Senior Democrats met last night with centrist House Republicans, trying to get a veto-proof majority for a child-health-insurance initiative opposed by Mr. Bush. Senate moderates played a part in an earlier 79-14 roll call overriding his veto of a water-resources bill. Moderates in both chambers will decide the future of a $151 billion education, labor and health-care budget approved by the House last night, 274-141, with 51 Republicans opposing the president.
The new dynamic reflects both the Democratic takeover of Congress and how Mr. Bush responded to it. In 1994, after Republicans took over, President Clinton saw a new middle ground defined by the election and moved away from fellow liberals in Congress. Mr. Bush did the opposite, moving to the right to shore up his conservative base, leaving an opening in the center.
The White House's more-confrontational tactics are a strategy calculated to disrupt the new majority and reduce the effectiveness of Congress to challenge Mr. Bush on the war in Iraq. The result has been a convergence of veto threats over spending levels and domestic policy, leaving little time for the two sides to reach deals.
A stopgap bill to keep the government funded until Dec. 14 neared passage last night, and Democrats have agreed to give the president his top priority: a $471 billion Pentagon budget including emergency funds for armored vehicles in Iraq. But new fights flared up in the House over war policy, and there is no peace in sight on the domestic front.
The education budget faces an almost certain veto. A $105.6 billion transportation and housing budget, approved by House-Senate negotiators, faces the same fate.
The White House argues that Democrats won no mandate in 2006 to increase spending and have floundered over how best to present the bills to Mr. Bush. "Their strategy changes by the hour," White House Budget Director Jim Nussle said. "I get different answers from every one of them."
Unaccustomed to the spotlight, Republican moderates find themselves in an uncomfortable role somewhere between being tied to the railroad tracks as the Democrats and White House come barreling down, and being the switchman who can save the train.
Yesterday's Senate vote on the water-resources veto was the first time Mr. Bush has been overridden. The more-telling test will come on the child-health-insurance and education bills now in play.
The health-care bill calls for an additional $35 billion in spending over the next five years to expand coverage for the children of working-class families. To win over moderates, Democrats are prepared to add tighter income limits and push more parents off the rolls. There has been a backlash from New Jersey and Rhode Island senators worried about the impact on their states; at the same time, House Republican leaders are pressing to pull their members back.
"There's a decent chance of a deal," said Senate Finance Committee Chairman Max Baucus (D., Mont.).
"I'm seeing the potential for some successes," said Rep. Joseph Knollenberg (R., Mich.).
As talks continue, a synergy has developed between the fate of the child-health bill and education budget, known as the "Labor H" bill -- so much so that the health talks even moved into the House Appropriations Committee rooms last night as members voted on the floor.
On a vote Tuesday night, it was evident that Republicans, who had stood with the president against the health-care bill, were looking for a chance to show their independence on the second bill, Labor H.

I had the same case. Call up the 800 number in the reciept and find options where you can change the address on the phone. The reason I tried this was because as the # is not in the system you can't even report a problem with the case.
Now when the representative is available, tell them the issue and they will connect you to someone who can verify the status for you. The next layer rep will ask your name and address for verification and tell you the status.

New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. I'm moving my exhaustion projection date back a week. My target is based on a rolling four week usage average so variations from week to week are discounted. I have visa stamp in the name of previous employer and I 797 from current employer. I have traveled with these and had no problems at re-entry.
But previous employer has completed processing of my H1B cancellation. Can I still re-enter with visa stamp in the name of previous employer?

Just got an email from Expedia.com - fares from Bay Area to Wash. D.C. have dropped by about $50 - the cheapest fares today (9/06/2007):

My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

Hi,
Please advice me on below:-
1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.
2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.
3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.
4) SO if I do h1b transfer or go on h4 what are the pros and cons.
Please let me know ASAP.

My parents got vistor visa (B1/B2) and planning to visit me,
my sister also got a visitor visa (B1/B2) through a company some time back. But she never visited US and later moved to another company.
All are 10 years multiple entry visas.
Is it okay that sister comes along with my parents? Is there a difference between company applied visitor visa and visitor visa that I sponsered.

My company is offering my retention contract for 3 years. As I told them that my GC can take long and I haven't filed for I-485 to use AC-21, I will be in trouble if a loose my job. Based on that they are making a written promose that I will have a same job for the next 3 years with all benifits and the only reason I can loose my job is through a decipline action (bad performance, fight, harrasment, etc).
I want to ask the attorney's and gurus if there is such a contract exist and does it have any value ?
