She can't work and you can't apply for work permit. You need to wait for the I-130 approval. Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

I am right now on L1A visa recently filed for extension and still in processing.
I am planning to get married to my girlfriend here and apply for greencard.

My H1b got Approved and starts from OCT 1st and OPT Extension Expires in July 1st week.
I am travelling to India for 2 weeks in next month.
Do I need to go for Stamping? or my Current student status is valid :confused:

On I140 form, notice type has information about INS section.
The INS section explain that your GC is under EB2 category or EB3 category.
INS section details
INA Section 203(b) (2) is EB-2
INA Section 203(b) (3) is EB-3

I am on L1B visa and valid until Oct2010; I somehow decide to apply for green card with certain personal reason.
As I understanding, the employer will file the green card petition for me. I'd like to what's the difference between filing from lawyer ("Duration"), because I am ready to hire a lawyer to file that for myself if it can shorten the duration to obtain a green card. What's the time range it will be processed from L1B to greencard?
My only concern is if it is a shortcut (duration) to file green card petition from lawyer instead of employer.

Employer B wishes to recruit me by transfer H1-B and utilize recapture time. The total time they would get is till Apr 2010 (which includes recpature time) along with 7th year I-797.
Employer B wishes to file LC 1 month after I join them.
Assuming that I join them by end of Dec 2009, I have the following questions about my H1-B extension
Lets consider Dec 30th as the date to start the LC application.
What I understand is that based on the LC from Employer B,

I fall in Schedule A which is going to retrogression begining Nov, 06.
I am on H4, meanwhile i just made it to file my I140, 485, 765 and AP concurenntly, hence will get my EAD, but no approved 485. My situation is I dont want to be with this employer for long for this is in upstate MI, where my spouse wont be able to continue the H1, hence we will be living seperate for sometime.
Now after my 140 approval and 485 pending for 6 months can i change the employer, I heard something with AC 21 you can. But what are the pros and cons with it.
Can my employer revoke the approved 140 after 6 months too.

I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.
My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..
Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..

I submitted 485 application for me (primary) and my wife (secondary); now she is changing her job before we can get the receipt for 485 filing....she is on h1B....the new employer will file her H1B transfer..........does anyone see any issue with this????

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

No issues, since her H1B is independent of your I-485. As long as she was in her old job/the job mentioned on her G-325 on the day you filed your app. you should be okay.

Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?
