My I-485 is pending with EB3 Feb 2006 priority date. Invoked AC21 and currently working for a different employer. Have Masters degree and 9+ years of experience.
Is there a way to re-apply for Green Card under EB2 category thru a 3rd employer and retain the old EB3 priority date?

Does any one have any advice about AC21
Is it advisable to file AC21 soon after changing/ joining new employer?
OR
Just keep quite and look for any RFE, if any RFE comes up send AC21 form and updated employer information along with it.
IS there any guidelines from people who already did it successfully

Hi There,
I need some advice on my current situation.I am in the 4th year of my H1-B .I have my
I-140 approved from my current employer with PD of Aug'09.
I am planning to change my job, my concern is :
Assuming that my current employer do not revoke/recall my I-140
1. Do i need to have the same job responsibilities in my new job to transfer my PD?
2. Do i have to stick with my current employer for atleast 6 months to transfer my PD?
3. What will happen if i change employer within 6 months, can i still be able to get my PD?
4. Will employers provide approval of I-140 ?

New filing fees were applicable from 7/30. Do all applications(485/131/765) whose PD is current need to filed with the new fees starting from 7/30? Or till 8/17 it can be filed with the old fees?

:confused: I came in US on 15 Oct 2006. The company A who had filed my H1 was not able to arrange a job for me till 5-Dec-06 & they were not paying me as well. So I contacted company B & they arranged a project for me & I started working for them & I am being paid by company B from 11-Dec-06 & company B started my H1 transfer without paystub. Now in this case my H1 transfer will approve or not.

I have read in the popular immigration forums that one can request a one time 3 year extension to H1b beyond the standard 6 year limit if one has an approved I140 and could not file I485 due to retrogression. I am confused on how does one go about requesting this..meaning is it sufficient to just put three years under the 'date of intended employment' in I129 form and have a labor condition approval with similar dates or do you have to include a copy of approved I140 and point to the 2005 Aytes memo that grants such a provision while you file for I129. By the way the situation is also a bit more complicated due to the fact that I am changing jobs (5th year H1) and trying to get a 3 year transfer based on approval from the company I am leaving.
Appreciate your inputs

yes, you can add her anytime before the approval of your I485 (3rd stage of the GC process). You havent mentioned EB1/2/3 but if its EB2 or EB3, stage 3 is several years away for you, and you can always add her before you apply for the final stage. Good luck!

I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.
I want to use AP again, is there any problem.

I am currently on H1B through company A previously I was working for Company B before that was working for Company C.
I transferred my H1B from C->B->A, Because of current Economy now my employer(Company C) is saying that if I lose my current project at client location he is going to cancel my H1.
If that happens can I go back to B Or C company, as My previous companies never cancelled my H1.
Appreciate any help here.

I am generally a lurker in this website. Based on the other threads, I came to the reality there is no way I am getting my GC for another 4-5 years or may be even longer.
However, the USCIS site has a status "Card/Document production". The last status update date was 6/25/2010. The only update I could think of is my new address around the same time. I went to the USCIS status website after 2 years out of curious, after I got back from giving my finger prints (3rd since I485 filing) today.
Is the USCIS jerking me off? :rolleyes:

My sister, as part of submitting documents for her fiance visa application, recently got a birth certificate. However, it doesn't have her name on it. Odd as it sounds, the municipality says that this is common practice. It just has the name of the parents.

On May 1, 2006, hundreds of thousands of immigrants around the country demonstrated against a restrictive immigration bill introduced in Congress. This weekend, similar demonstrations will occur around the US. I'll be attending my 20th law school reunion in Chicago this weekend and am hoping to attend that rally. I'd really rather be at the one in Phoenix and look forward to hearing reports from there.

Hello, my wife and I have been approved and got notice of action (I-797C) in mail May 23 (recieved date May 22). Online USCIS states our cards went into production June 13th and allow 30 days to recieve. We have not moved but will in mid August in order to begin work under OPT. We called USCIS service center on 1-800-375-5283 on 30th day and put in a trace on our cards. USCIS states case will be assigned within 30 days and then expect within 45 days to hear. This is impossible as we hope to begin work before that. I know that calls can be made to get permission to work as we are F-1 graduating Aug 8th BUT need the cards for our bank to approve financing.
Question - is there any way to make direct contact with someone who can tell us the card WAS mailed and provide confirmation. It is odd that regulkar mail delivers such a valuable, time consuming document.
Any comments would be helpful.
