Hi All,
I'm looking for solutions in my situation.
I'm currently under a L1 visa for a company A but I would like to resign and look for another Job.
The thing is, as far as I understood, If I resign I have to leave the US. So here are my questions:
1) How long can I stay in the US after I resigned from my company under a L1 visa? Can I stay in the US even if my I-94 is valid?
2) How is the USCIS notified that I resigned from my company? Should I send a notification or is that done by my company?
3) Can I apply to a H1B COS by myself to then look for a job? Or will I need a company B to sponsor me?
4) If I can't apply to a H1B COS by myself, do I have any other visa options?

Dear All,
I've approved H1 until Apr 2011 (expired stamping in the passport) and also have EAD (I applied 485 when my family was out of country, my mistake). But as my family don't have their 485 applied, I have to be on H1. Now my confusion is when I travel out of country can I use AP to re-enter or I have to use H1 only as my family is on H4?

We filed for our 2nd AP on July 2nd. They received it on 8th and mine was approved on 22nd. Got my AP yesterday. No idea what happened to my spouse's. I got that RN from the back of the check and called USCIS. I entered the 10 digit RN and it said not enough numbers entered?? So i called again and said no RN and i got a cust service rep. I gave her the RN and she said they received it on 8th and is still processing it. She said it doesn't matter whether we filed together and asked us to wait 6 months.
Is this normal? I just hope the other AP is not lost.
Also since there is no expiry date on the AP, is it to be taken as its valid only for 1 year from the date of issue? We never had to use our 1st AP.

it asks last five year employment history , i have not worked in USA for the past 3 year but i have worked abroad before these 3 years.. should i write it in the column or i should write NONE as i have not worked here in USA .... i am not the primary applicant ... my husband is primary applicant

But I just submit I-765 (EAD) renew by 6/22/08. Now I found out my I-140 and I-485 are all approved. Can I revoke or withdraw I-765(EAD) from USCIS?

I work from home and one week a month i go to my consulting company office

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. Due to a sudden demise of my wife's grandmother, my wife had to go to India last week. She is planning to come back by Nov. 15. I received the receipt notices for my wife's I-485, I-131 and I-765. My question is if the fingerprinting notice comes before she arrives and also if it is scheduled prior to her arrival date on Nov. 14; what are the options of rescheduling and can we get the date of our choice after Nov. 14. Also, I would be extremely grateful, if someone could upload a sample fingerprinting notice from USCIS. I couldn't find any where on the site.

Can I count part time experience obtained before my Bachelors degree for an EB2 petition?
I have 2.5 years of part time experience, can we use this and apply with MBA+1 requirements?

Fancy meeting you here, dohko! The experience at half time can be counted to be 1/2 time itself - i.e. 2 years under 20 hrs./week = 1 yr. full time.
Your experience however has to be obtained AFTER your Bachelor's degree.

As per the latest regulations, the employer has to pay for all the labor application cost. My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Can they deduct part of my salary to bear the cost etc...?

Thats illegal. You don't want to get into trouble in future so please do not do that.
